Amburn Law’s IP Department Shares Important Message with IR Global

In a recent post in UK based IR Global network newsfeed, Dean Amburn, director of IP Services informed firms that the new USPTO trademark rule requires foreign entities to use a U.S. Attorney.

“We thought it was crucial for foreign nationals to understand that a U.S attorney must represent individuals or entities applying for or maintaining a U.S. Trademark.” said Amburn who is a member of the organization.

If an applicant does not comply with the new rule, they will receive an office action and are allowed a limited opportunity to retain U.S. counsel.  An applicant or registrant must show evidence of U.S. attorney retention to avoid abandonment of any pending trademark application or registration.

To avoid delays or potential abandonment it is essential to consult with U.S. counsel to ensure compliance with the new rule requirements.

Amburn Law has experience working with global organizations and foreign nationals. Recently, they took to trial and won a significant trademark infringement dispute between Canadian based Bombardier Recreational Products Inc. and Jaguar Land Rover Limited regarding the Defender brand.
